Model Terms and Conditions of Sale – ARCA II (GoldInBlock)

These terms and conditions of sale are concluded, on the one hand, by the company ARCA II with a share capital of €2,000, whose registered office is located at 8 Place de la Paix, 31600 Muret, France, registered with the Toulouse Trade and Companies Register under number 795229657 00015, hereinafter referred to as “ARCA II,” which manages the GoldInBlock website at www.goldinblock.com, and, on the other hand, by any individual or legal entity wishing to make a purchase via the GoldInBlock website at www.goldinblock.com, hereinafter referred to as “the buyer.”

 

Article 1. Purpose

These terms and conditions of sale aim to define the contractual relationship between ARCA II and the buyer and the conditions applicable to any purchase made through the GoldInBlock website at www.goldinblock.com. Purchasing a product via this site implies the buyer’s unreserved acceptance of these terms and conditions of sale, which the buyer acknowledges having read prior to placing their order. Before any transaction, the buyer declares:

  1. That the purchase of products on the GoldInBlock website at www.goldinblock.com is not directly related to their professional activity and is limited to strictly personal use.
  2. That they have full legal capacity to commit to these general terms and conditions of sale.

The company ARCA II reserves the right to modify these terms and conditions of sale at any time to comply with new regulations or improve the user experience of its website. Therefore, the applicable terms will be those in effect on the order date.

 

Article 2. Products

The products offered for sale are those listed on the GoldInBlock website at www.goldinblock.com, operated by ARCA II, subject to availability. ARCA II reserves the right to modify the assortment of products offered on the site at any time without prior notice.

Each product is presented with a detailed description of its main technical characteristics, including material, weight, and dimensions. However, due to the artisanal nature of their production, the products may exhibit slight variations in dimensions, weight, or finish compared to the descriptions provided. These variations, inherent to the manufacturing process, cannot be considered defects or non-conformities but instead attest to the uniqueness and artisanal craftsmanship of the creations offered.

The photographs and illustrations of the products presented on the site are for indicative purposes only and are not contractual. ARCA II shall not be held liable for any differences between the appearance of the products on the site and the delivered products, provided that they meet the essential characteristics described.

The sale of products on the GoldInBlock website at www.goldinblock.com is open to buyers residing in countries where the import and possession of these products are fully authorized by applicable laws. It is the buyer’s responsibility to ensure that their order complies with the regulations in their country of residence.

 

Article 3. Pricing

The prices listed on the product pages of the online catalog are in Euros (€), inclusive of all taxes (VAT), based on the applicable French VAT rate of 20% on the order date. Any changes in the VAT rate may be reflected in the product prices based on the delivery address provided by the buyer. ARCA II reserves the right to modify its prices at any time, but the price listed in the catalog on the order date will be the only price applicable to the buyer.

The listed prices do not include shipping costs, which are charged in addition to the product prices based on the total order amount. For all European countries (including Switzerland, Norway, and Andorra), shipping costs are free for orders of €5,000 or more (inclusive of VAT). For orders below €5,000 within and outside Europe, a flat shipping fee of €100 (inclusive of VAT) will be charged to the buyer.

Article 4. Orders and Payment Methods

Before placing an order, the buyer must create an account on the GoldInBlock website at www.goldinblock.com. The account creation section is accessible directly from the side menu. Upon each visit, the buyer must log in using their account information to place an order or access their account details (order status, profile, etc.).

Payment Options:

  1. Bank Transfer:
    The buyer selects the products they wish to order in the “cart,” modifies if necessary (quantities, references, etc.), verifies or updates the delivery address, and selects the shipping option. After choosing “Bank Transfer” as the payment method, the buyer confirms their order by clicking “Confirm my order.” They then contact their bank to complete the transfer to ARCA II’s bank account. Once the payment is received, the order is processed, and the buyer is notified by email.

  2. Cryptocurrency (via Coinbase Commerce):
    Buyers wishing to pay in cryptocurrency can select this secure payment option during checkout. After confirming their order and accepting the terms, a secure Coinbase Commerce link is generated, enabling payment in Bitcoin, Ethereum, or other cryptocurrencies. Once the transaction is confirmed, the buyer receives an email confirmation.

  3. PayPal or Credit Card (via PayPal):
    The buyer can choose to pay using PayPal or a credit card. After completing the necessary steps in the cart and selecting “PayPal” or “Credit Card” as the payment method, they are redirected to PayPal’s secure interface to complete the transaction.

The buyer receives a confirmation email for each successful transaction. The products are shipped within two business days of payment confirmation.

 

Article 5. Ownership Reservation

ARCA II retains full ownership of the products sold until full payment, including principal, fees, and taxes.

 

Article 6. Withdrawal

For Standard Products:

The buyer has fourteen (14) working days from the receipt of their order to exercise their right of withdrawal without justification. The buyer may return the product for an exchange or refund, excluding return shipping costs.

For Customized Products:

Pursuant to Article L121-21-8 of the French Consumer Code, the right of withdrawal cannot be exercised for goods made to the consumer’s specifications or clearly personalized. Therefore, customized products cannot be returned or exchanged, except in the case of a defect or non-conformity.

 

Article 7. Delivery

Deliveries are made to the address indicated on the order form and must be within the agreed geographical area. Orders are shipped via COLISSIMO, DHL, or UPS with tracking and delivery against signature. Delivery times are indicative; if they exceed thirty days, the buyer may cancel the order and receive a refund.

ARCA II will provide the buyer with a tracking number for their package. The buyer is responsible for verifying the condition of the package and its contents upon delivery. In case of damage during transport, complaints must be filed with the carrier within three days of delivery.

Article 8. Warranty

All products sold by ARCA II come with the legal warranty provided under Articles 1641 and following of the French Civil Code. In case of non-conformity, the product can be returned to ARCA II for repair, replacement, or refund.

 

Article 9. Liability

ARCA II is only bound by a best-effort obligation in the distance-selling process. It cannot be held liable for damages resulting from the use of the internet, such as loss of data, intrusion, viruses, or service interruptions.

 

Article 10. Intellectual Property

All elements of the GoldInBlock website are the exclusive intellectual property of ARCA II. No one is authorized to reproduce, exploit, or use any elements of the site, including photos, logos, visuals, or text, without prior written consent.

 

Article 11. Personal Data

ARCA II is committed to preserving the confidentiality of information provided by the buyer. Any information concerning the buyer is subject to the provisions of Law No. 78-17 of January 6, 1978. Buyers have the right to access, modify, or delete their information by sending a request to ARCA II.

 

Article 12. Dispute Resolution

These terms and conditions are governed by French law. Any disputes or claims will be subject to the jurisdiction of the Toulouse Court.
